English to Arabic: Pre-registration Opposition presented before the trademark office General field: Law/Patents
Source text - English 1. The Opponent denies each point raised by the Applicant in the counterstatement, including the Applicant’s claim that the opposition was submitted after the deadline. The Applicant’s application was published on 31 July 2019 and the Opponent filed its opposition on 29 August 2019. The opposition was therefore filed within the 30-day deadline.
We enclose a copy of the publication notice, opposition as filed and opposition payment receipt confirming that the opposition was timely filed.
2. The Applicant claims to have amended its mark from the word “XXX” to the below:

However, the Applicant has failed to provide any evidence of such an amendment. Nonetheless, even if the Applicant has amended its mark, the s amended mark is still highly likely to cause confusion with the Opponent's Mark.
3. The Applicant’s amended mark still contains the dominant and distinctive word XXX, which is identical to the Opponent' Mark. The additional words “DUCTILE IRON MANHOLE COVERS” are merely descriptive and do not serve to distinguish the marks.
4. While the marks are in different classes, this does not prevent a finding of similarity nor a risk of confusion.
5. The Opponent submits that the Applicant's goods in Class 6 are either identical ("pipes") or at least highly similar or complementary to the Opponent's goods in Class 17. Both marks cover "pipes" and although the respective goods are made from different materials, it is common for both metal and plastic pipes to be sold side by side, or for metal pipes to have plastic parts and fittings, and vice versa.
6. Regardless of their material, the goods of the Applicant and the Opponent would be sold in the same channels of trade and would target the same consumer. It would be a natural extension of the Opponent's business to sell plastic goods alongside its metal goods.
7. The consumer, on seeing the identical mark XXX being applied to both metal goods (in Class 6) and plastic goods (in Class 17) would automatically assume that the goods originate from the same entity.
8. The identical nature of the marks, and the highly similar and complementary nature of the respective goods in Classes 6 and 17 will undoubtedly lead to consumer confusion and deception. The consumer will be unable to distinguish the goods of the opponent from the goods of the applicant, which will cause damage to the goodwill and reputation of the Opponent's XXX trademark.
9. As evidenced in the Notice of Opposition, the Opponent provided evidence of the prior use and registration of its XXX mark dating back to 1996, which includes copies of registration certificates from the UAE, Qatar and Saudi Arabia as well as screen shots from its website.
10. Accordingly, the opponent requests that the opposition is upheld and the Applicant's mark is refused.
Translation - Arabic 1- تجحد الجهة المعترضة كافة المزاعم التي أثارتها مقدمة الطلب في مذكرتها الجوابية، بما في ذلك زعمها بأن الاعتراض قد قُدم خارج الميعاد القانوني، علماً بأن الطلب المقدم من مقدمة الطلب كان قد نُشر بتاريخ 31 يوليو 2019 وتقدمت الجهة المعترضة باعتراضها بتاريخ 29 أغسطس 2019، وبذلك يكون الاعتراض مقدماً ضمن المهلة القانونية المحددة بثلاثين (30) يوماً.
نرفق لكم طيه صورة عن إشعار النشر وعن صحيفة الاعتراض بصيغتها التي قُدمت بها وإيصال رسوم تسجيل الاعتراض الذي يؤكد تقديم الاعتراض ضمن المهلة المقررة.
2- تزعم مقدمة الطلب بأنها قد عدّلت شكل علامتها من "XXX" لتصبح على الشكل الآتي:

وعلى الرغم من ذلك لم تفلح مقدمة الطلب في تقديم ما يثبت إجراء أي تعديل. وحتى ولو كانت قد أجرت تعديلاً على علامتها على هذا النحو، فإن احتمالات الخلط بين علامة مقدمة الطلب المعدلة وعلامة الجهة المعترضة ما تزال كبيرة.
3- إن علامة مقدمة الطلب المعدلة ما تزال تحتوي على عبارة XXX المميزة والمهيمنة على شكل العلامة، وهي مطابقة لعلامة الجهة المعترضة. وأما عبارة "DUCTILE IRON MANHOLE COVERS" التي أضيفت إليها فهي مجرد عبارة وصفية لا تصلح لتمييز العلامات التجارية.
4- إنه وإن كانت العلامتان تقعان ضمن فئتين مغايرتين لبعضهما البعض، فهذا لا ينفي تشابههما ولا يستبعد احتمالات اللبس بينهما.
5- تؤكد الجهة المعترضة بأن منتجات مقدمة الطلب المودعة في الفئة 6 مطابقة (أنابيب) أو على الأقل مشابهة أو مكمّلة لمنتجات الجهة المعترضة المودعة في الفئة 17. فكلتا العلامتين تشملان "الأنابيب"، وعلى الرغم من أن منتجات كل طرف مصنّعة من مواد مختلفة عن الأخرى، إلا أن من الشائع أن تًباع الأنابيب المعدنية مع الأنابيب البلاستيكية جنباً إلى جنب، أو أن يكون للأنابيب المعدنية قطع ووصلات بلاستيكية، والعكس صحيح.
6- وبصرف النظر عن المواد الداخلة في صناعة المنتجات، إلا أن منتجات مقدمة الطلب والجهة المعترضة ستباع عبر نفس القنوات التجارية وستستهدف نفس فئة العملاء. كما أن لجوء الجهة المعترضة لبيع منتجات بلاستيكية مع منتجاتها يعتبر امتداداً طبيعياً لعملها.
7- حين يرى المستهلك علامة XXX على منتجات معدنية (الفئة 6) ومنتجات بلاستيكية (الفئة 17) فسوف يفترض تلقائياً أن جميع تلك المنتجات تأتي من مصدر واحد.
8- إن التطابق الظاهر بين العلامتين والطبيعة المتشابهة لمنتجات الفئتين 6 و17 وتكميل إحداها للأخرى، سيؤدي لا ريب إلى إيقاع المستهلك في حالة من اللبس والخداع. فالمستهلك لن يكون قادراً على تمييز منتجات الجهة المعترضة من منتجات مقدمة الطلب، الأمر الذي يلحق الضرر بسمعة ومكانة العلامة التجارية XXX العائدة للجهة المعترضة.
9- كما يتضح من إشعار الاعتراض، فإن الجهة المعترضة قد تقدمت بما يثبت أسبقية تسجيلها لعلامة XXX منذ العام 1996، بما في ذلك تقديم صور ضوئية عن شهادات تسجيل صادرة في كل من الإمارات وقطر والسعودية، بالإضافة للقطات شاشة لموقعها الإلكتروني.
10- وبناء على ما تقدم، تطلب الجهة المعترضة قبول الاعتراض ورفض قيد علامة مقدمة الطلب.
