As far as I know Mar 15, 2016

it should read:

Defendant personally appeared with his attorney
or
Defendant personally appeared represented by his attorney

Regards,

Teresa

They were both present at the Court? Defendant and Attorney? Mar 15, 2016

Thank you but the text is exactly as I wrote it: Defendant personally appeared in this action by his attorney.
So maybe he appeared personally and his attorney was present too (?????)

badly written, maybe Mar 15, 2016

The original text seems badly written. The "by" doesn't fit with the rest.

Either in person or through (by) his attorney Mar 15, 2016

The whole point of appearing in person is that you aren't appearing by proxy (or through an attorney).

Attorney Mar 15, 2016

Maybe the attorney and the defendant were there side by side?

Merriam-Webster's: Simple Definition of by
: close to or next to (something or someone)

Alternative interpretation Mar 15, 2016

'by' as in "legal action brought by X against Y"

Defendant personally appeared in this action by his attorney
--> literally (with no need to assume there might be any errors in the text)
Defendant appeared personally in this action institigated against the defendent by his (ex, presumably) attorney.

The attorney has started a law-suit against his/her own (former) client, and said client has chosen to represent him/herself, without legal represe

The attorney has started a law-suit against his/her own (former) client, and said client has chosen to represent him/herself, without legal representation (=personally - this being quite legitimate in some countries).

The correct interpretation will surely be evident from the wider context (to which we are not privvy).

Edited to add: This should have been posted as an eng-eng Kudoz question.

Unless you are able to confirm from your client that this is indeed a case of badly written text and this line should be interpreted as suggested by the earlier posters to this thread, you can only go by the literal meaning of this sentence which is as Robin Levey puts it.

The case appears to be between the defendant on one side and his own attorney on the other (fighting against the defendant).

Maybe, some issue over the settling (or not settling) of the atorney's legal fees by the defendant!!!!
