Lawmaking Treaties and Other Material Sources
It may seem untidy to depart from discussion of the 'formal' sources, of which custom is the most important, and yet a realistic presentation of the sources involves giving prominence to certain forms of evidence of the attitude of states to customary rules and general principles of the law. 'Lawmaking' treaties (...) and drafts adopted by the International Law Commission have a direct influence on the content of the law, an influence the significance of which is not conveyed adequately by their designation as material sources.
